What will replace no win no fee arrangements?

Imagine you’ve received a personal injury at work or suffered from medical negligence and you want redress but do not have enough money to pay for a personal injury solicitor.

Some people mistakenly think that solicitors are only here to help the rich, but this is simply not true. If you want to make a personal injury claim there are many accident solicitors who will currently be able to help you on a ‘no win, no fee’ basis. Your solicitor’s legal costs will be settled by the third party if you are awarded personal injury compensation. In the unfortunate event that your claim is not successful, your lawyer will often be able to claim his costs through a legal insurance policy.

It is important to understand that personal injury compensation will only be awarded to people who have genuinely suffered pain and suffering or financial loss as the result of an accident. The court will require evidence of this from a specialist, such as a doctor.

No win, no fee claims for compensation were introduced in Britain in 1995 to replace legal aid. However, last week Kenneth Clarke, the justice minister, announced that no win no fee deals are to be scrapped. The government is now working on plans for new American style legislation which will come into force early next year.
